In order to use the "Orange Cones. No Phones." e-Toolkit and its contents (the "e-Toolkit"), you must read, understand and agree to the following terms and conditions. Please read these provisions carefully, and contact the Sponsors for an explanation of any terms and conditions you do not understand. By checking the "I Accept" box and providing your email address, you will signify acceptance of these terms and conditions.

The Sponsors of this e-Toolkit are Transurban, Fluor Enterprises and AAA Mid-Atlantic and their respective affiliates, related companies and contractors (hereinafter the "Sponsors").

  1. The purpose of this e-Toolkit is to help organizations raise awareness about the dangers of distracted driving while driving through active construction zones (hereinafter the "Campaign"). This e-Toolkit is intended for use by state departments of transportation and their contractors, subcontractors, affiliates and partners (each hereinafter referred to as the "User") to develop the Campaign in their local and regional areas.
  2. The User acknowledges the Sponsors' exclusive right, title and interest in the e-Toolkit. Subject to these terms and conditions, the Sponsors hereby grant to the User the limited non-exclusive, nontransferable, nonassignable, revocable right and license to use the e-Toolkit.
  3. The User is permitted to use, copy and distribute the materials within the e-Toolkit on its external website, in press releases, in its marketing materials, in other materials produced by the User and on signage in its construction zones.
  4. The User shall acknowledge the Sponsors as creators of the Campaign in any description of the Campaign the User provides to the public (e.g. boilerplate language in press releases).
  5. The User is permitted to revise, add or delete certain components of the e-Toolkit only as it relates to customizing the e-Toolkit for its organization for use in the Campaign. Any customization should not alter the facts or content as it relates to definitions and statistics.
  6. The Sponsors reserve the right to revoke the User's license to use the e-Toolkit, and will provide advance notice to the User, any time the User breaches any of these terms and conditions. The User shall be liable for any and all damages suffered by the Sponsors should the User breach any of these terms and conditions.
